Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TheLocalList website and services located at thelocallist.com.au (the "Service"), operated by TheLocalList ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By creating an account, submitting a listing, or otherwise using the Service, you confirm that you are at least 18 years of age, have the legal authority to enter into these Terms (either on your own behalf or on behalf of a business entity), and agree to comply with these Terms and all applicable Australian laws and regulations.

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We will notify registered users of material changes by email.

2. Account Registration

To list a business or access certain features, you must create an account. You agree to:

  • Provide accurate, complete, and current registration information.
  • Maintain the confidentiality of your password and be responsible for all activity under your account.
  • Notify us immediately at hello@thelocallist.com.au if you suspect unauthorised access to your account.
  • Not create accounts for the purpose of circumventing these Terms or misrepresenting your identity.

You may only maintain one account per business entity. We reserve the right to refuse registration or terminate accounts at our discretion.

3. Listing Guidelines

When submitting or maintaining a business listing, you agree that:

  • All information in your listing is accurate, truthful, and up-to-date, including your business name, address, phone number, and category.
  • You are authorised to list the business and act as its representative on the Service.
  • Images and content you upload are either owned by you or you have the necessary rights and licences to use them.
  • You will update your listing promptly if your business details change.
  • You will not create duplicate listings for the same business.

We reserve the right to edit, remove, or decline any listing that does not meet our standards or these Terms.

4. Prohibited Content

You must not submit, post, or distribute any content through the Service that:

  • Is false, misleading, or deceptive in contravention of the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)).
  • Infringes any intellectual property rights, including copyright, trade marks, or design rights.
  • Is defamatory, harassing, threatening, obscene, or otherwise unlawful.
  • Contains malware, viruses, or other harmful code.
  • Constitutes spam, unsolicited bulk messaging, or promotes multi-level marketing schemes.
  • Relates to illegal goods or services, or businesses that do not hold required licences or permits.
  • Impersonates another person or entity.

5. Pricing

TheLocalList is currently free to use. All features are available at no cost. We may introduce optional paid plans in the future, in which case we will notify users by email with at least 30 days' notice. Your existing free listing and features will remain available.

6. ABN Verification

All business listings on TheLocalList require a valid Australian Business Number (ABN). By submitting an ABN, you confirm that:

  • The ABN belongs to the business you are listing and that the business is currently registered and active.
  • You are authorised to represent the ABN holder.
  • You understand that we will verify the ABN against the Australian Business Register (ABR) and may display ABR data (such as business name and registration status) publicly on your listing.

Listings associated with ABNs that become inactive or cancelled may be removed without notice. We are not responsible for errors in the ABR data.

7. Intellectual Property

TheLocalList and its content, features, and functionality (including the website design, logo, software, and text we have created) are owned by us and protected by Australian and international copyright, trade mark, and other intellectual property laws.

By submitting content to the Service (including business descriptions and images), you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and reproduce that content solely for the purpose of operating and promoting the Service. You retain ownership of your content.

You must not reproduce, distribute, or create derivative works from any part of the Service without our express written permission.

8. Limitation of Liability

To the maximum extent permitted by Australian law, TheLocalList shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to loss of profits, data, goodwill, or business opportunities.

Our total liability to you for any claim arising out of or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months prior to the claim, or (b) $100 AUD.

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited.

9. Termination

You may close your account at any time by contacting us at hello@thelocallist.com.au or through your account settings.

We may suspend or terminate your account and access to the Service immediately, without prior notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or illegal activity, or posed a risk to other users or the integrity of the Service. Upon termination, your listings will be removed.

Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property, limitation of liability, and governing law.

10. Governing Law

These Terms are governed by the laws of Australia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Australia. If you are a consumer, you may also have rights under the consumer protection legislation of your state or territory.
